SHORT TERM BOOKING RENTAL TERMS 

 

Airbetter Holiday Homes LLC (‘’Airbetter’’) is a marketplace in the business of providing Revenue Management, Offline and online sales and marketing services to hotels, Serviced Apartments and Properties in general, including locating and booking lodging for customers. 

AIRBETTER is able to arrange for Landlords to be introduced to tenants via Airbetter’s direct customer base, Airbetter Network and Booking Providers. 

Airbetter acts as an intermediary only between the landlord and the tenant. The tenant understands and agrees that when booking one of Airbetter’s property’s, he is in effect renting the property directly from the landlord and not Airbetter.     

The tenant has agreed to use the services of Airbetter on the terms herein contained (‘’ Rental Terms of the Agreement’’) with regard to his stay at the property. 

If the Tenant has booked his stay through a travel channel or a third party, this Agreement complements all and any other terms agreed at the time of the booking.  

Once Payment is made, this agreement is automatically transmitted to the tenant along with his booking confirmation or with his payment receipt.  

This Agreement is also accessible and visible on all online travel channels the tenant may book with and where the property is advertised.  

If the tenant does not object to the terms within 4 hours of receipt, these terms are binding.  

Rental Terms of the Agreement: 

  1. The Landlord has the right to inspect the premises without prior notice at any time to enforce the terms of this agreement. Should the Tenants violate any of the terms of this agreement, the rental period shall be terminated immediately. The Tenants waive all rights to process if they fall to vacate the premises upon termination of the rental period. The Tenants shall vacate the premises at the expiration time and date of this agreement.  

  2. In the event that the landlord sells the property during the Tenant’s stay, the Tenant will be provided with 2 weeks written notice to vacate the property. This clause cannot be argued, discussed or refuted and the Tenant is fully aware that the sale of the Property he is currently staying in could happen at any time. If a sale takes place a notice of 2 weeks will be given to the Tenant and future payments, if any will be refunded to the Tenant upon check out. 

  3. The Tenants shall maintain the premises in a good, clean and ready to rent condition, and use the premises only in a careful and lawful manner. The Tenants shall leave the premises in a ready to rent condition at the expiration of the rental agreement, defined by the Landlord as being immediately habitable by the next tenants. Tenants shall pay for maintenance and repairs should the premises be left in a lesser condition. The tenants agree that the landlord shall deduct costs of said services from the security deposit prior to refund if tenants cause damage to the premises or its furnishings. 

  4. The Tenants shall dispose of all waste material generated during the rental period in a lawful manner and put the trash in the bins in the designated waste disposal bin area during their stay for pickup. Tenant is cautioned not to leave trash for long periods of time because it attracts animals and pest. 

  5. The Tenants shall pay for any damage done to the premises over and above normal wear and tear. 

  6. No animals or pets of any kind will be brought onto the premises. 

  7. The Tenant shall not sublet the property. 

  8. The Tenants shall have no more than 4 (four) adult persons to sleep on the premises.  

  9. The Tenants shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners. The Tenants shall not create noise or disturbances likely to disturb or annoy the surroundng property owners. Creating a disturbance of the above nature shall be grounds for termination of this agreement and Tenants shall then immediately vacate the premises. Quiet hour stars at 10 PM and noise should be kept to a minimum. 

  10. There shall be no smoking inside the premises. Smoking is permitted outside the home. 

  11. Landlord shall provide towels, linens, cups, knives, forks, spoons, dishes. 

  12. The Tenants and Tenants’ Guests shall hereby indemnify and hold harmless the Landlord and Airbetter against any all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. Tenants expressly recognize that any insurance for the property damage or loss which the Landlord may maintain on the property does not cover the personal property of Tenants, and that Tenants should purchase their own insurance for Tenants and guests if such coverage is desired. 

  13. The security deposit will secure the performance of Tenant’s obligations. Owner may, but will not be obliged to, apply all portions of said deposit on account of Tenant’s obligations. The security deposit is refundable if there is no damage and the unit is left in a clean condition. The balance of all deposits will be refunded within 2 weeks from date possession is delivered to Landlord or his or her authorized agent, together with a statement showing any charges made against such deposits. Cleaning services are available for additional charges. In the event that the apartment is not clean and in tidy condition by check-out time, the sum of AED 500 will be charged additionally for the cleaning service. 

  14. Tenants expressly acknowledge and agree that this Agreement is for transient occupancy of the property, and that Tenants do not intend to make the property a residence or household. 

  15. There shall be no refunds of rents and security deposit due to shortened stays or reined expectations because of weather conditions. 

  16. There shall be not refunds of rents and security deposit because of shortened stays or ruined expectations due to work and family emergencies or other commitments. 

  17. It is the tenant’s responsibility to learn about safety precautions, warning signs of water conditions, and safety procedures concerning swimming in or being around the pool. Tenant agrees to have a responsible adult supervising minor while they swim in the pool. Tenant is hereby notified that the pool can be dangerous and tenant accepts fully the risks involved. There are no rails to prevent a fall into the pool. 

  18. Only legally owned and permitted firearms shall be allowed on the premises according to local laws. 

  19. Tenant agrees that Fireworks and other hazardous materials shall not be used in or around the property.  

  20. Tenant shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc. shall cause termination of this agreement with no refund of rents or deposits 

  21. Tenant shall see to their own security while in the property by locking doors, windows, garage doors, etc. when it’s prudent to do so. 

  22. Booking deposits will not be refundable in the event of your cancellation or failure to pay on time.  

  23. In the event of no payments received by contract obligation, the agreement is terminated by landlord in unilateral order. And the apartment must be vacant on the same day. 

  24. Changing the keylock of the apartments or making copies is strictly forbidden.  

  25. An additional charge of AED500 per access card lost or missing will be charged or deducted from the Tenant’s Security Deposit.
